SCOTTSDALE, Ariz. -- At Fiesta Bowl headquarters near the Scottsdale Fashion Square mall Friday afternoon, there is a line out the door to buy tickets.

Fans are looking to snag seats for Saturday?s Buffalo Wild Wings Bowl at Sun Devil Stadium in Tempe and Thursday?s Tostitos Fiesta Bowl at the University of Phoenix Stadium in Glendale.

Fiesta Bowl Executive Director Robert Shelton says he expects about 40,000 people to attend the Buffalo Wild Wings match-up between TCU and Michigan state and 70,000 people to watch Oregon and Kansas State battle it out in Glendale.

?We expect to sell out the Fiesta Bowl,? Shelton said.

Tickets are still available for the Buffalo Wild Wings Bowl, but Shelton said only suite seats are left for the Fiesta Bowl.

?Surprisingly, you might get a better deal on those seats than buying from a scalper on the streets,? he said.

Of the 120,000 or so tickets sold so far for bowl week, about half are sold back to the teams. The rest go on the market to the public, at an average price of $220.00.

?That brings in about $14 million,? said Shelton.

Over the past five years, Shelton said bowl games have brought in more than a billion dollars to the Valley of the Sun and the state of Arizona.

?This year, I would estimate with two bowl games, we?re going to see about $250 million,? Shelton said.

Most of the money comes from out of state visitors spending money in hotels and restaurants.

The Buffalo Wild Wings restaurant in Tempe Friday was packed with more than 300 members of the Michigan State band and cheerleading team.

?We have staff from all of the stores in the region coming to help us out,? said Assistant General Manager Ric Stanfield.

Stanfield said he expects even more business tomorrow, before the bowl game.

?We?re going to turn this entire parking lot into an extended Buffalo Wild Wings. Beer tents, food tents, live bands,? Stanfield said.

When Stanfield was asked if this weekend would be hectic he responded, ?I think so, but it?s a good kind of hectic.?

CEO of GMM's satellite TV unit plans to step down soon - The Nation

Home ? business ? CEO of GMM's satellite TV unit plans to step down soon

GMM

The Nation
December 28, 2012 1:00 am

"It's about the time to step down as younger executives Fahmai and Rafah Dumrongchaitham, sons of chairman Paiboon Dumrongchaitham, are ready to make this business sustainable," Thana said.

He stressed that his target for this year was achievable, including the success of GMM Z brand building and a million sales of satellite-TV set-top boxes as projected.

He also cited success in building a strong team at GMM Z that was tested by several challenges, noting that the Euro 2012 fiasco was an example.

The CEO said he had spoken several times about his wish to resign with Paiboon, whom he described as his big brother. He was initially invited to join the company as an adviser to the chairman in mid-2011 when GMM Grammy decided to jump into the cable/satellite TV business.

He said he intended to send his resignation letter to Paiboon in February or March.

If he gets the green light to leave GMM Z, he could continue supporting the company as an adviser for Paiboon or set up his own business in support of the GMM broadcasting service.

He said he had not decided yet to join another firm, but a source in the broadcasting industry reported that he had been offered key posts with leading telecommunication firms such as InTouch as well as international banking services such as Citibank.

"I will make my final decision after talking with Paiboon next year," he stressed.

Before joining GMM Grammy, Thana was CEO of PK Garment (Import-Export), the manufacturer and distributor of Mc Jeans.

He was also well known for his expertise while working as a marketing executive for Total Access Communication (DTAC).

Patient Care Technician Registered Nurse Training Programs Chicago

nurse training Chicagowww.TTIMedicalSchool.com

Do you want to become a Nurse in the growing healthcare industry and you don?t have a clear path to achieve your goal?

Did you know that a Bachelors of Science degree in nursing can cost up to $55,000 or more.? Did you know that you can become a nurse at 1/10 of this cost or about $5,500.? There is a path that can lead you to become a Registered Nurse (RN) and here is the secret to your success.? It?s simple. CNA to PCT to RN.? CNA> nursing home position, then PCT > hospital position, then the hospital will pay you to work and to complete your nursing degree via their hospital benefits program.? Here are the 5 steps:

???? First, choose a healthcare training school, that provides a great Nurse via Certified Nursing Assistant (CNA) training program.?? Becoming a Certified Nursing Assistant is the first and most important step in reaching your goal to become a nurse.? This is because, for a low investment cost in education, you can take and pass the state CNA examination. This path will allow you to begin work in a nursing home, assisted living or home health care environment.? By taking and passing this rigorous program you will learn the basics of ?compassionate caregiving? and you will see if this is truly your life ambition.

? ? ?Jobs as a Certified Nursing Assistant are plentiful.? After you pass the State examination, you will apply to 6 nursing homes in person and you will usually get 1-2 job offers.? You can pick the offer you prefer and jump into a full time CNA position with benefits.? Completing training and becoming a CNA is like the ?boot camp? of healthcare.? You learn the basics that you will never forget as you move into other phases of your successful healthcare career.

? ? ?Your next step is to take additional classes to become a Nurse via Patient Care Technician (PCT).?? PCTs learn phlebotomy skills, i.e. how to draw blood and EKG skills i.e. working with the heart monitoring systems.? Becoming a Certified Phlebotomy Technician and a Certified EKG Technician allows you to sit for the national Certified Patient Care Technician examination through the National Health career Association. Our school, T.T.I. Medical Training, offers the theory, practical and clinical aspects to pass these examinations.

? ? ?Once certified, and with some working experience as a CNA, you can now apply to get hired by a hospital.? Your hourly wage will increase from $9-$11 hr. as a CNA to $15-$18 hr. as a PCT.? Hospitals love to hire CNA?s with some nursing home experience to work as PCT?s. As a Patient Care Technician you will have new and added responsibilities by providing more technical skills to patients. You will be performing venipuncture and additional testing like: pulse oximetry, electrocardiograms and other testing as ordered by the doctor.? Compassionate caregiving skills are still instrumental and enhanced through more experience in the PCT position.

? ? ?Finally, if you do a great job in your Nurse via Patient Care Technician position i.e. coming to work on-time, providing excellent patient care, working with your healthcare team, you can inform the hospital that you wish to pursue a degree in nursing.? Believe it or not, the hospital will accommodate your work schedule and pay your tuition.? You may have to sign an agreement that you are willing to work at the hospital for a specified time period for their education investment.? As former student, Kathy, told me,? ?I love working at this hospital, I would never leave.? They paid for my tuition and now I?m an Registered Nurse in the acute ward!?? If Kathy can do it, so can you.

Becoming a Nurse via CNA and Patient Care Technician training program is a unique and cost effective path to achieve your dream.? Our school, T.T.I. Medical Training, has several former students take this secret path to their new found success. Others plan to move into challenging and rewarding careers as: Physicians Assistant (PA) or Nurse Practitioner (NP) or even Doctor of Medicine, M.D.? Age and gender is not a factor as both men and women of all ages can take this path.? For more information about this unique path from CNA to PCT to RN contact? (773) 941-9000 or www.TTIMedicalSchool.com for an immediate free consultation ?so that you can begin to achieve all that you can believe!?

(AP) ? Lawmakers are engaged in a playground game of "who goes first," daring each political party to let the year end without resolving a Jan. 1 confluence of higher taxes and deep spending cuts that could rattle a recovering, but-still-fragile economy.

President Barack Obama returns from Hawaii Thursday to this increasingly familiar deadline showdown in the nation's capital, with even a stopgap solution now in doubt.

Adding to the mix of developments pushing toward a "fiscal cliff," Treasury Secretary Timothy Geithner informed Congress on Wednesday that the government was on track to hit its borrowing limit on Monday and that he would take "extraordinary measures as authorized by law" to postpone a government default.

Still, he added, uncertainty over the outcome of negotiations over taxes and spending made it difficult to determine how much time those measures would buy.

In recent days, Obama's aides have been consulting with Senate Democratic Leader Harry Reid's office, but Republicans have not been part of the discussions, suggesting much still needs to be done if a deal, even a small one, were to be struck and passed through Congress by Monday.

At stake are current tax rates that expire on Dec. 31 and revert to the higher rates in place during the administration of President Bill Clinton. All in all, that means $536 billion in tax increases that would touching nearly all Americans. Moreover, the military and other federal departments would have to cut $110 billion in spending.

But while economists have warned about the economic impact of tax hikes and spending cuts of that magnitude, both sides appear to be proceeding as if they have more than just four days left. Indeed, Congress could still act in January in time to retroactively counter the effect on most taxpayers and government agencies, but chances for a large deficit reduction package would likely be put off.

House Republican leaders on Wednesday said they remain ready to negotiate, but urged the Senate to consider or amend a House-passed bill that extends all existing tax rates. In a statement, the leaders said the House would consider whatever the Senate passed. "But the Senate first must act," they said.

Aides said any decision to bring House members back to Washington would be driven by what the Senate does.

Reid's office responded shortly after, insisting that the House act on Senate legislation passed in July that would raise tax rates only on incomes above $200,000 for individuals and $250,000 for couples.

Meanwhile, Obama has been pushing for a variant of that Senate bill that would include an extension of jobless aid and some surgical spending reductions to prevent the steeper and broader spending cuts from kicking in.

For the Senate to act, it would require a commitment from Senate Republican Leader Mitch McConnell not to demand a 60-vote margin to consider the legislation on the Senate floor. McConnell's office says it's too early to make such an assessment because Obama's plan is unclear on whether extended benefits for the unemployed would be paid for with cuts in other programs or on how it would deal with an expiring estate tax, among other issues.

What's more, House Speaker John Boehner would have to let the bill get to the House floor for a vote. Given the calendar, chances of accomplishing that by Dec. 31 were becoming a long shot.

Amid the standoff, Geithner advised Congress on Wednesday that the administration will begin taking action to prevent the government from hitting its borrowing limit. In a letter to congressional leaders, Geithner said accounting measures could save approximately $200 billion.

That could keep the government from reaching the debt limit for about two months. But if Congress and the White House don't agree on how to avoid the "fiscal cliff," he said, the amount of time before the government hits its borrowing limit is more uncertain.

"If left unresolved, the expiring tax provisions and automatic spending cuts, as well as the attendant delays in filing of tax returns, would have the effect of adding some additional time to the duration of the extraordinary measures," he wrote.

Whenever the debt ceiling hits, however, it is likely to set up yet another deadline for one more budget fight between the White House and congressional Republicans.

Initially, clearing the way for a higher debt ceiling was supposed to be part of a large deal aimed at reducing deficits by more than $2 trillion over 10 years with a mix of tax increases and spending cuts, including reductions in health programs like Medicare. But chances for that bargain fizzled last week when conservatives sank Boehner's legislation to only let tax increases affect taxpayers with earnings of $1 million or more.

Obama and his aides have said they would refuse to let Republicans leverage spending cuts in return for raising the debt ceiling. But Republicans say the threat of voting against an increase in the limit is one of the best ways to win deficit reduction measures.

Another potential showdown is pending. A renewed clash over spending could come in late March; spending authority for much of the government expires on March 27.

Happy Holiday Dog Treats

Ingredients

  • 1? cups whole wheat flour
  • 1 cup unbleached flour
  • 1/2 cup oats
  • 1/3 cup bran
  • 2 tablespoons dry milk
  • 1 ? teaspoons dry yeast
  • 2 tablespoons Spearmint Leaves? or 1 teaspoon peppermint extract
  • 1/2 cup applesauce
  • 2 teaspoons green food coloring or Spinach Powder? (to get the color desired)
  • 7/8 cup water

    Directions for Christmas Dog Treats

With all of my recipes, you can use a mixer with a dough hook or a bread machine. I prefer the bread machine, as it?s so much easier. If you use a mixer, simply adjust the directions for making bread with your mixer.

    • Place everything in the bread machine on the dough cycle.
    • When the dough is ready, roll it to1/4? thick with a rolling pin.
    • Cut into mini dog bone shapes and bake at 250 degrees F for about an hour. Check to make sure that they don?t get too brown.
    • Turn off the oven and let the mini dog bones dry completely in the oven? This works best overnight.

These Christmas dog treats will keep for at least a month, so you can make them well ahead of the holidays.

Dogs love the mint flavor, and mint is helpful to dogs with digestive problems or sensitive stomachs.? Mint will also help to freshen your dog?s breath!

The following is a list of the most viewed special education advisor blogs from 2012. Thank you for your continued support and without further adieu here is the list:

1.? How to Prepare for an IEP (Updated)

We live in an unprecedented era where schools are dealing with shrinking budgets and fewer resources but still must figure out how to educate an increasingly large number of student age children.? This is compounded by the fact that class sizes are increasing and the number of credentialed Teachers are decreasing due to layoffs.? Just like every other area of education, school districts are trying to figure out ways to cut special education costs as well.? Even though cost cannot be a factor when determining services in an Individualized Education Program (IEP) the children receiving the appropriate services are the ones whose parents are educated and prepared when attending their child?s IEP.? This makes it even more important to be prepared for your next meeting.? This article will help you truly prepare for the next IEP meeting.

2.? But it?s in their IEP

Five little words, made up of only sixteen letters that every parent has uttered at one point or another if their child has an IEP.? Who we said it to isn?t as important as the fact that we have all said it.? I have written in the past about my Top Ten Special Education Pet Peeves and the Top Ten Most Ridiculous Comments I Ever Heard at an IEP but it?s time to discuss a new topic.? Below?are the top responses heard after I uttered the words, ?but it?s in their IEP.?

1.? Your child has an IEP no one ever gave me a copy??

2.? Oh, I don?t read IEPs.

3.? OSEP Provides Guidance on the Number of Transition Goals Required in an IEP

When the Individuals with Disabilities Education Act (IDEA) was reauthorized in 2004 the U. S. Department of Education through the Office of Special Education Programs (OSEP) required states to develop State Performance Plans based on 20 indicators. The data would be submitted annually, by each State, in Annual Performance Reports. The 13th Indicator, or Indicator 13, relates to transition services for students.

The National Technical Assistance and Dissemination Center (NSTTAC) which is funded by OSEP helps States achieve compliance with indicator 13 and have put together a checklist and a checklist frequently asked questions to help in their efforts.

4.? Proposed DSM-5 Changes and Autism: Ed vs. Med

If the Proposed DSM-5 changes have the effect predicted by the New York Times article, New autism definition may exclude many, study suggests, then these changes will cause a huge upheaval in the lives of many families who struggle with Autism every day. According to the New York Times Article:

Hundreds of thousands of people receive state-backed special services to help offset the disorders? disabling effects, which include learning and social problems, and the diagnosis is in many ways central to their lives.

The diagnosis of autism is unfortunately the gateway to many state and medical services. In an ideal world it shouldn?t matter what the label is, if the child has a need for services they should be able to access those services. As we all know we don?t live in an ideal world. While the diagnosis of Autism is the gateway to state and medical services it does not work that way in Public Schools. You see there is a HUGE difference between a medical diagnosis of autism and an educational definition of autism. Before I expand on this point let?s look at the proposed changes.

5.? Top 10 Items that Should Be Listed in an IEP

We all know how important it is to have an IEP that addresses our child?s Academic, Developmental and Functional needs; to ensure they are appropriately prepared for an independent future.? Therefore, as parents, we have to make sure our child?s IEP includes the necessary information to prepare them for life after high school.? The results of your child?s most recent assessments, report cards, state tests, school personnel and parent input will assist the team in developing an appropriate IEP.

Your child?s IEP should include the following information:

1.? A statement of your child?s Present Levels of Academic Achievement and Functional Performance.

6.? Top Ten Special Education Pet Peeves

Today?s blog post is meant to be cathartic for me personally. Since I spend my days entrenched in Special Education, I have become particularly sensitive to the following pet peeves. Wikipedia defines a pet peeve as, ?a minor annoyance that an individual identifies as particularly annoying to him or her, to a greater degree than others may find it.? While some of the list below consists of minor annoyances, others make me down right angry.

1. Schools don?t diagnose they determine eligibility;

A day doesn?t go by without a phone call from a parent who tells me their child was diagnosed with Autism by the School District. School District?s DO NOT diagnose rather they have determined your child is eligible for an Individualized Education Program (IEP) under the eligibility category of Autism.

7.? Addressing Bullying in an IEP

As a Parent the first reaction you have when someone is bullying your child is to emulate your best Al Capone impression from the Untouchabales.

I want you to get this guy where he breathes! I want you to find this Eliot Ness, I want him dead! I want his family dead! I want his house burned to the ground! (I have edited this quote for language and shortened it but you get the idea)

While this might be your first reaction, this also happens to be the worst possible course of action. When your child is being bullied the number one issue should be your child, not the other child?s punishment. This is an extremely hard pill to swallow but is necessary for your child?s safety and well-being. Children with disabilities are very often the target of bullying but these same children will most likely have an Individualized Education Program (IEP) which can be used as an effective way to address the bullying. Before addressing the issue in an IEP the following steps should be taken in writing:

9.? My Favorite Autism & Disability Communities on Facebook

Last month I published a list of Special Education Facebook Pages to Like. This was an extensive list of Companies and Organizations that focus primarily on Special Education. What was left off of this list was all of the amazing communities on facebook dedicated to creating a warm, loving, supportive, and nonjudgmental environment for parents raising children with autism and other special needs. Most of these communities are run by parents just like you and me. While I run the Special Education Advisor community page on facebook I spend just as much time on many of the community pages listed below. I also enlisted the help of Jessica at Autism Moms to bolster the list with some of her favorites as well.

10.? Strength Based IEPs

When most people hear about a child that has an Individualized Education Program (IEP) the first thing that crosses their mind is, ?I wonder what their deficits or needs are.?? This is because too many IEPs are being written using the deficit model. ?The deficit model focuses on the student as the major problem, neither looking within the environment nor the instructional practices in the classroom.? As Kral stated way back in 1992, ?if we ask people to look for deficits, they will usually find them, and their view of the situation will be colored by this. If we ask people to look for successes, they will usually find it, and their view of the situation will be colored by this?. ?Only focusing on the child?s deficits could have the following effects, 1) the IEP will not work very well, and 2) it will cause self-esteem issues and behavior problems with the child.

The Note's Must-Reads for Monday December 24, 2012

The Note's Must-Reads are a round-up of today's political headlines and stories from ABC News and the top U.S. newspapers. Posted Monday through Friday right here at www.abcnews.com

Compiled by ABC News' Carrie Halperin, Amanda VanAllen and Jordan Mazza

FISCAL CLIFF

The Hill's Vicki Needham: " Business groups grow frustrated over impasse in 'fiscal cliff' talks" Business leaders are growing increasingly frustrated with the lack of progress in talks to head off billions in looming tax hikes and spending cuts they say will harm the nation's economy. Concern increased among business groups following the failure of House Republicans to round up enough votes to pass their "Plan B" bill that would have stopped tax increases on anyone making $1 million a year or less. LINK

The Wall Street Journal's Patrick O'Connor and Peter Nicholas: "How 'Cliff' Talks Hit The Wall" Congressional leaders and President Barack Obama called Friday for a return to negotiations to avert the so-called fiscal cliff, a day after talks cratered in a very public fashion when Republicans abandoned House Speaker John Boehner's backup plan. LINK

The New York Times' Jonathan Weisman: " Search for Way Through Fiscal Impasse Turns to the Senate " With little more than a week for lawmakers to avert huge tax increases and spending cuts, attention is turning from the gridlocked House to the Senate, where some Republicans on Sunday endorsed President Obama's call for a partial deal to insulate most Americans from the tax increases but defer a resolution on spending. Senators Kay Bailey Hutchison of Texas and Johnny Isakson of Georgia, both Republicans, implored Senate leaders to reach an accommodation with Mr. Obama when Congress returns on Thursday, even if that meant that taxes would go up for those with high incomes and that spending cuts would be put off. LINK

Politico's Mackenzie Weinger: " Media finds fiscal cliff a steep climb" The fiscal cliff could very well send some in the media over the edge. For journalists and pundits, the fiscal cliff has been a nearly all-encompassing political story in D.C.'s post-election media landscape. LINK

USA Today's Susan Davis: "Questions and answers about the dreaded 'fiscal cliff'" President Obama and congressional leaders are struggling to come up with a long-term deficit reduction plan to avert the year-end "fiscal cliff" when all of the George W. Bush-era tax rates expire and $1.2 trillion in unpopular spending cuts over a decade begin. The combined economic effect of the two could send the U.S. economy back into a recession. A number of other laws, including a payroll tax holiday and unemployment benefits, are also scheduled to expire at the end of the year unless Washington acts. The president and House Speaker John Boehner, R-Ohio, have been unable to bridge the partisan divide over taxes and spending cuts, and Boehner's alternative effort to avert the cliff failed to muster enough GOP support to pass. The Los Angeles Times' Paul West and David Lauter: " Republican rifts mean more gridlock, obstacles for Obama" In the days immediately after President Obama's reelection victory, White House officials hoped that in a second term he might have better relations with congressional Republicans. Crapo, 61, was arrested in Alexandria, Va., at 12:45 a.m. when he failed a field sobriety test, said police spokesman Jody Donaldson. LINK

The Washington Post's Philip Rucker and Sari Horwitz: "On gun control, Obama's record shows an apparent lack of political will - until now" The survivors of a gun rampage in Tucson came to Washington in August with a simple message for the Obama administration: Do something - anything - to stop the violence. Sandy Hook exposes the logic gap in opposition to gun control

After Sandy Hook shooting in Newtown, we again hear arguments against gun control, chiefly that new laws won't keep guns from evil-doers. But no one would argue that homicide laws have no place just because they can?t stop all killings. The point is, gun control will reduce carnage, if not stop it.

The main arguments against tougher gun control being trotted out again after the mass shooting in Newtown, Conn., represent a fallacy of logic ? perhaps not clearly seen until now.

You?ve heard the counter-arguments before: Such laws won?t keep guns out of the hands of those determined to use them unlawfully; miscreants bent on evil will have their way with or without guns; and the violence at Sandy Hook Elementary School presents a mental health issue, not a gun-control question.

It will be argued in the coming weeks and months that bans on semi-automatic weapons and high-capacity ammo clips as well as stricter standards and longer waiting periods for gun permits are simply off the mark or ineffective. And after the media refocus on the fiscal cliff and Syria, the arguments may very well help thwart reform as they have countless times before.

Indeed, Congressman Pete Sessions of Texas tells us ?Guns aren?t the problem; sick people are.? Former Arkansas Gov. Mike Huckabee let us know that ?[w]hen somebody has an intent to do incredible damage, they?re going to find a way to do it.? And, as commentator Bill O?Reilly told us right after the massacre in the Colorado movie theater, ?The truth is, criminals will always get guns.?

There is, of course, great truth to these arguments. But whether Adam Lanza in Newtown or the killers at the Colorado theater or Virginia Tech or the Sikh temple in Wisconsin or Columbine, Colo., would have been stymied by gun control measures is not the central issue.

Even if particular killers would have obtained a weapon anyway, opposition to gun regulation on the basis that it won?t keep guns out of the hands of murderers or that mental health resources could be brought to bear in these cases reflects what is known in formal logic as the ?red herring fallacy.? This is when one argument is used to deflect attention from what?s really at issue.

Legislation aimed at limiting access to guns, like all other law designed to protect human life, is not put forward in the na?ve belief that it will prevent all wrongful loss of life or that it?s a substitute for mental health care and education.

No one would argue, for example, that homicide laws have no place on the books just because a legal proscription can?t prevent all killings and timely counseling might have dissuaded a perpetrator. And even if our homicide laws prevented only a handful of murders, they would still serve a useful purpose. The fact that a law won?t completely eradicate a particular harm is not an argument against its adoption.

This holds true for gun regulation. The point is that, as with all law designed to protect life and limb, tighter gun control laws will reduce the carnage. Even a modest measure banning, for example, the high-capacity ammunition magazines used in these atrocities would have saved many innocent lives.

The arguments that guns would still fall into the wrong hands, that death will be wrought by other means, and that those who pull the trigger often have mental health problems are a sleight of hand when offered to defeat tighter gun controls.

As federal and state proposals for gun regulation sweep across the nation in the aftermath of the Sandy Hook tragedy, the opponents of these measures will place before us evidence of imperfection and, in a dangerous deception, represent it as proof of illegitimacy. Lawmakers must see through this fallacy.

Jay Sterling Silver is a law professor at St. Thomas University in Miami Gardens, Florida. His commentary has appeared in the The New York Times and other national and local media.

In this edition of the Digest, we talk about our family trees, the ?fiscal slope?, and share a few videos ranging from perhaps the most beautiful flash mob ever to a quick Cliff Notes of Obamacare.

Climbing the Family Tree
At Yeske Buie, we recently went through the exercise of fleshing out our own family trees and had the experience of remembering family members, the lessons we learned, and being reminded of all of our connections, past and present. ?We recently sent our clients a booklet that contained those family trees, along with a few blank ones for their own families to complete.

We offer up the example of Dave?s and Elissa?s family trees, along with a blank one that you can print out and complete for yourself during the holidays.

Slippery slope: budget negotiations, the markets, and you
We?re sure that you?re sick and tired of hearing about the fiscal cliff at this point, and we don?t blame you. ?The looming tax increases and spending cuts have spawned no end of ?cliffhangers? and ?Cliff Notes? describing the impending doomsday if Congress and the White House can?t agree to an alternative.

We think the more accurate description in all of this has been the recharacterization of the fiscal cliff as a fiscal slope.

Perhaps the most beautiful flash mob ever . . .
Our good friend Ed Jacobson, PhD, author of Appreciative Moments, just sent us a video that we thought you?d appreciate. ?Ed asks, ?Can you invest 5 minutes 41 seconds for an antidote to news of tragedy and fiscal cliffs?? ?Elissa, meanwhile, called it ?perhaps the most beautiful flash mob ever? . . .

Science link to boost languages

The National Centre for Languages in Wales has turned to the sciences to reverse the decline in pupils choosing a foreign language at GCSE.

The centre, also called Cilt Cymru, is working with 32 schools to encourage teenagers to study a language.

One project is with Stemnet, which promotes science, technology, engineering and maths (Stem).

It wants pupils to consider career prospects from combining science subjects with a language.

Science is compulsory in Wales at GCSE but modern foreign languages are not.

The idea is to show pupils who are considering their GCSE options that studying Stem subjects alongside languages can improve job opportunities in the UK and Europe.

Jana Witt is from Germany but is now studying a PhD at Cardiff University. She is a Stemnet "ambassador".

"As a scientist, you are being sent abroad constantly," she said.

World stage

"You're going to conferences, and even if it's a conference in the UK, there'll be people from all over the world there and it just helps so much if you can speak their language".

Sarah Broadhead speaks French and Spanish and explains how language learning helps in her career

GCSE pupils in Wales have a choice of at least 30 courses but many are not opting for foreign languages.

In the past five years, the number of pupils in Wales taking French at GCSE fell by 28%. Entries for German fell by 38%. It is a similar pattern in England.

Kristina Hedges, of Cilt Cymru in Cardiff, warns that Wales needs to keep pace with the rest of Europe in language skills if it is to compete on the world stage.

The Welsh government said it is committed to promoting foreign languages in schools.

Foreign languages are not compulsory in primary school either, but a spokesperson said guidance is available to the schools that choose to teach those subjects - and that it encourages others to incorporate it into the curriculum.

Emotional moment for Sandy Hook Elementary School shooting victims

Firefighters take part in a moment of silence near the entrance to Sandy Hook Elementary School, Dec. 21, 2012.??

NEWTOWN, Conn.?Bells rang out here and across the country 26 times following a moment of silence on Friday morning, one week after a gunman opened fire at Sandy Hook Elementary School, killing 27 people?including 20 children?in one of the deadliest school shootings in U.S. history.

Connecticut Gov. Dan Malloy ordered the statewide moment of silence to occur at 9:30 a.m., ?exactly one week after the horror began to unfold.? Malloy took part in the symbolic gesture at Edmond Town Hall on Main Street in Newtown as rain poured down outside. Across Main Street, church bells tolled at Trinity Episcopal Church, where the funeral service for 6-year-old Benjamin Wheeler was held the day before.

At the entrance to Sandy Hook Elementary, across the street from the firehouse where children and their parents were reunited on the day of the shootings, faint bells could be heard in the distance. About 40 people, including several firefighters, stood silently in the rain and wind?so strong that it knocked down two of the 26 Christmas trees that line the road?at one of the many makeshift memorials that dot the small town of 27,000.

Three firefighters, including a captain of the Sandy Hook Vol. Fire and Rescue, cried while they hugged each other. No one spoke.

Bells also rang from Saint Rose of Lima Church on Church Hill Road, where many of the funerals for the victims?who include the gunman's mother, Nancy Lanza?have been held. Funerals for more victims were scheduled later Friday.

In Washington, D.C., President Barack Obama took part in the moment of silence privately, the White House said.

Online, scores of websites went dark for several minutes to honor the victims.

After the moment of silence, a Sandy Hook resident walking away from the firehouse said: "Maybe now we can begin to heal."

How to Choose the Right Franchise in 10 Steps ? Business ...

bcom-sy-07o-corporate-law2.jpg

There are many well-known franchise opportunities available in almost every industry you can think of. Some are well established with proven systems and support structures in place, while others are relatively new. Choosing the franchise that suits you will reduce risk and raise the levels of success. While specialist advisors are a necessity to assist you throughout your business venture, the following steps will help you to evaluate any franchise opportunity you are considering.

1. KNOW YOURSELF

The first topic of research will be you. Consider your strengths and weaknesses. What is your level of knowledge, where might you need development and are your skills transferable? Will you be able to manage the high level of personal energy required to get yourself started? Are you a team player, or do you prefer to work alone? Will you require staff? Only after you have analyzed the depth of commitment required to start a new business venture will you be in a position to make a specific choice.

2. KNOW YOUR FINANCIAL COMMITMENTS

The costs of a franchise can vary considerably. While smaller investments can be affordable through personal assets, most potential franchise owners will need to consider additional borrowing. The increase in small business ventures have compelled many banks to have business start up kits, which include information on the requirements of starting a business, self evaluation reports and financial planning forms. No matter how much security you can offer, banks need to be convinced that loans can be serviced. What the proposed business can afford is more important than what you have.

3. KNOW WHAT FRANCHISING IS

Find out all you can about franchising. In particular focus on the unique relationship that exists between franchisees and franchisors. Look for a Franchise Association closest to you to obtain guidance from. Once again the banks can provide a wealth of information in this regard; it is now within their interests to build relationships in an extremely competitive financial environment by providing separate departments that serve the franchise industry. Search the internet, but be aware that different countries will have different compliance issues. Even if you have a preference this early in the game, research is still a vital process that needs to be completed. There is also the chance that research will open up alternatives you may not have previously considered.

4. KNOW THE INDUSTRY

You have already analyzed your skills and knowledge; now look at the different types of businesses that you feel are potentially suitable. Identify the different companies that are offering opportunities in the area. Consider the requirements of the proposed industry and see if it matches your skills and aspirations. It is not necessary for you to have worked in this industry before, but you need to feel comfortable and happy working in this environment. How durable is the potential market? Who are your customers? Who are your competitors? Is it an international franchise or newly introduced to your area? Is the market large enough to sustain a long-term business? Get to know the franchisor. You need to be happy with the industry you will be working in and with the people you will be working with.

5. EVALUTE THE FRANCHISE

Once it is established that you are interested in a particular franchise, information will be sent to you. Read all the information you receive thoroughly noting any first impressions and any initial questions you may have. Discuss and clarify any concerns you have with the franchisor. The size of the franchise should not restrict the availability of information you need regarding the company?s history and profile, market conditions, the franchisees role and the costs involved. Examine company records in detail, check credit references. Closely examine the outline of the franchise particularly the manner in which the franchise is sold and operated. Look at all the details of any commissions? payable on the sale of the franchise and ask to see references of present franchises and company outlets. Make sure you understand the components that make up the franchise fees.

6. QUESTIONS FOR THE FRANCHISOR

The greatest source of information you will obtain regarding the franchise system is from the franchisor. Prepare for every meeting with your list of items that need to be clarified. Ask all the questions you need in relation to the franchise, products and services. Do not be afraid to ask questions relating to the profitable viability of the franchise. You need to find out the success of the franchise, talk to other franchisees as well. What training and support exists? Is the franchise bound by any code of practice?

7. TALK TO THE FRANCHISEES

The surest method of evaluating any franchise will be to talk to a number of franchisees in existing businesses. In this way, you will get a realistic assessment. What value have they got from their business, both financial and personal? Make sure you chose the franchisees to speak with. You may not get a balanced picture if you speak only to ?approved? franchisees. The perspective of international outlets can also be of use, but, remember to consider different conditions, population structures and competition.

8. SPECIALISED FINANCIAL ADVICE

There could be some reluctance on the part of the franchisor to reveal financial projections in case they are viewed as guaranteed. However, what reports are available should provide relevant figures based on the existing climate. Whether the projections you receive are forecasted or guaranteed, an accountant with franchise experience should be able to give you qualified advice. Encourage your accountant to work with the franchisor. The franchisor will be able to offer cash flow, borrowing and overdraft guidelines. Take all the advice you can get. As a new business owner you do not want to start your business under capitalized.

9. SPECIALISED LEGAL ADVICE

It is important to fully understand the terms and conditions of the franchise agreement. Understanding your obligations and the franchisors responsibilities need to be clear from the start. Use a lawyer that specializes in franchise agreements to define legal terms you have difficulty with to save you time and money.

10. CHECK WHAT YOU ARE PAYING FOR

Before you sign on the dotted line, make sure you know what the up-front franchise fee includes and what refunds you may expect if you change your mind or fail the training. What are the performance criteria? You must also have a clear understanding of any ongoing costs. You need to know what fees are payable, how they are calculated and what they are for.

To maximize your chances of success it is imperative you do not rush your decision. Check out all aspects before you commit yourself. Be 100% certain that the franchise is right for you before you part with your money.

Next In Line For A Fracking Boom, California Looks At The Rules

Most hydraulic fracturing in California is done to extract to oil in areas like this field in Kern County. The state is drafting fracking regulations for the first time.

Craig Miller/KQED

Most hydraulic fracturing in California is done to extract to oil in areas like this field in Kern County. The state is drafting fracking regulations for the first time.

Craig Miller/KQED

The controversial drilling technique known as hydraulic fracturing has created an oil and gas boom around the country. In states like Texas, Pennsylvania and Colorado, there's been heated debate about rules that protect groundwater and public health.

California is now wading into that arena with the release of the state's first fracking regulations. The state's earthquake-prone geology, however, could bring particular concerns.

Fracking itself isn't new. The technology behind it, though, has changed.

"We don't do things the way we used to do them," says Ben Shepperd, who heads the Permian Basin Petroleum Association, a regional trade group in West Texas.

"In the '20s, a frack job was once you drill a hole, you drop TNT down the hole and crack the rock that way. That was an old-fashioned frack job," he says standing next to a towering rig that's drilling a new oil well on the outskirts of Midland.

Fracking technology has come a long way. Oil companies now drill horizontally underground along a layer of oil-saturated shale rock. Then they crack the rock by injecting water mixed with sand and chemicals at high pressure.

The West Texas oil industry went bust 30 years ago, but it's currently booming. Shepperd says companies are spending $1 billion a month on drilling in the region.

Next in line for a fracking boom could be California, which is sitting on one of the largest shale oil resources in the country.

"There's a high degree of public interest in this, a high degree of legislative interest in this," says Jason Marshall of California's Department of Conservation.

The state's newly proposed rules are similar to others' in many ways, he says. Drillers would have to pressure test wells and monitor them during and after fracking. But there are new requirements, like looking for old oil wells around fracking sites that could create leaks. "So we are leading in a number of these areas," he says.

Not everyone agrees. "I think we were late to this game," says Bill Allayaud of the non-profit Environmental Working Group. He says just a few years ago, California state regulators were slow to admit that fracking was going on at all.

"They said we don't need to frack here. We don't need to get gas out of the ground that way," he says. "But it turns out we've been getting oil out of the ground that way for decades."

Drillers weren't required to report fracking to the state, but under the proposed rules, they would be. Regulators would then make that information public online.

But Allayaud says landowners near oil wells would have to keep checking that website, because oil companies wouldn't be required to contact them directly.

"Why not?" he asks. "If this stuff is so safe, you're saying you're not polluting anyone's groundwater, let them know in advance so if they want to do their own water quality testing, more power to them."

Like in other states, drillers would have to say what chemicals are in their fracking fluid ? unless it's considered a trade secret. Tupper Hull of the Western States Petroleum Association says that information is propriety.

"There's a reason we protect trade secrets and it's not to benefit oil companies," he says. "It's to benefit consumers and to ensure we've got a very competitive marketplace."

Recently, though, concerned lawmakers in Texas have said their trade secret rule is so heavily used, it's become a loophole.

And then there's one more issue: "It takes a big fault to make a big earthquake," and California has plenty of those, says Mark Zoback, a geophysicist at Stanford University.

The risk of a big earthquake from fracking itself is relatively low. But there could be an issue with the fracking wastewater. Drillers often dispose of it by injecting it underground, which builds up pressure.

"You don't inject into existing faults, especially big ones," Zoback says.

California regulators say the fracking rules don't address that because it's handled in existing wastewater rules, but Zoback says the state will have to increase its scrutiny.

"You know it's not [whether] hydraulic fracturing is good or hydraulic fracturing is bad," he says. It's whether "hydraulic fracturing is safe or hydraulic fracturing is unsafe."

California's geology is so complex, says Zoback, that safety has to be considered on a site by site basis.

Are You Eligible For Bankruptcy | Eric Finance

Are You Eligible For BankruptcyYou have probably heard the saying, ?Live while you are young.? Unfortunately, many people feel as if that means that they can do anything you want, even if they cannot afford it. If you have been frivolous with your money, you probably are finding yourself knee deep in debt. You have enormous credit card bills and loans that you cannot pay, and your credit score is plummeting. If your debt is spiraling out of control with no end in sight, you might want to see if you are eligible for bankruptcy.

Chapter 7 bankruptcy allows you to eliminate your unsecured debt. Unsecured debts include credit cards, medical bills, personal loans and utility bills. Because Chapter 7 bankruptcy is becoming common, laws have been implemented to reduce the amount of bankruptcies filed. In order to file for bankruptcy, you must pass a ?means test.? This is a test that compares your income to the average income of the state. In order to pass the test, your income must be less than the median income of a family of the same size in your state. In order to determine your income, you take your average income over the last three months.

If the means test does not meet the qualifications to file for bankruptcy, you can still qualify if you do not have enough disposable income. Your disposable income is income that is left over after you have paid your monthly obligations. If your disposable income is over a specific amount, you will not pass the means test, so you cannot file for bankruptcy.

The calculations for the means test will differ according to where you live. You can use online calculators to determine if you will pass the means test. You will enter information about your expenses and income, and the calculator will determine if you pass. If you fail the test, you will need to file for Chapter 13 bankruptcy.

In addition, in order to file for bankruptcy, you must owe at least $1000, and you must be unable to make your monthly payments. You must also have inadequate non exempt assets that would not be able to pay your creditors if liquidated. Furthermore, you are not permitted to file for bankruptcy if you have been given a Chapter 7 discharge within 8 years of refilling.

Chapter 7 bankruptcy can be a difficult and time-consuming process. A bankruptcy attorney can help determine if bankruptcy is the right solution for you. He can assess your finances, and calculate the numbers. If you do qualify for bankruptcy, you will need the assistance of a bankruptcy attorney.

Your financial situation can get out of control before you know it. Therefore, bankruptcy might be the best way to start over with your money. Each state has different laws concerning bankruptcy, so you need to be familiar with the laws in your state. Research your options to see if bankruptcy might be right for you. You can then put your financial mistakes in the past and look forward to a brighter financial future.

Soybeans a source of valuable chemical

Dec. 19, 2012 ? The humble soybean could become an inexpensive new source of a widely used chemical for plastics, textiles, drugs, solvents and as a food additive.

Succinic acid, traditionally drawn from petroleum, is one focus of research by Rice chemists George Bennett and Ka-Yiu San. In 2004, the Department of Energy named succinic acid one of 12 "platform" chemicals that could be produced from sugars by biological means and turned into high-value materials.

Several years ago, Rice patented a process by Bennett and San for the bio-based production of succinic acid that employed genetically modified E. coli bacteria to convert glucose into succinic acid in a way that would be competitive with petroleum-based production.

The new succinate process developed by Bennett, San and Chandresh Thakker and reported recently in Bioresource Technology promises to make even better use of a cheap and plentiful feedstock, primarily the indigestible parts of the soybean.

"We are trying to find a cheaper, renewable raw material to start with so the end product will be more profitable," said Thakker, a research scientist in the Bennett lab at Rice's BioScience Research Collaborative and lead author of the study. "The challenge has been to make this biomass process cost-competitive with the petrochemical methods people have been using for many years."

Bennett feels they have done that with soybean-derived feedstock as an inexpensive source of the carbon that microorganisms digest to produce the desired chemical via fermentation. "A lot of people use plant oils for cooking -- corn or soybean or canola -- instead of lard, as they did in the old days," he said. "The oils are among the main products of these seeds. Another product is protein, which is used as a high-quality food.

"What's left over is indigestible fiber and small carbohydrates," said Bennett, Rice's E. Dell Butcher Professor of Biochemistry and Cell Biology. "It's used in small amounts in certain animal feeds, but overall it's a very low-value material."

The Rice researchers are changing that with the help of E. coli bacteria engineered to process soy meal that generally gets discarded. Certain microbes naturally produce succinic acid from such feedstock, but manipulating E. coli's metabolic pathways (by eliminating pathways that produce other chemicals like ethanol, for instance) can make it far more efficient.

Expanding on their success in producing succinic acid from glucose, the new microbes are engineered to metabolize a variety of sugars found in soybean meal. The theoretical ideal is a 1:1 ratio of feedstock (the extracted sugars) to product, which they feel is achievable by industry. In the lab, under less controlled conditions, they still found the process highly efficient. "We're demonstrating a very high yield," Thakker said. "We're achieving in a flask a non-optimized formation of succinate that is close to the theoretical goal."

Bennett said his lab has been looking at soybeans for nearly three years. "We're always interested in low-cost feedstock," he said. "We were able to get a connection with a soybean group that is very interested in technologies to make better and more profitable use of their crop.

"There's a fair amount of oilseed residuals available, including cottonseed carbohydrates, that are not used for any high-value product, and we're in the space of microbial engineering to enable these sorts of materials to be used in a good way," he said.

Analysis: Lumia sell-out no proof of Nokia turnaround

HELSINKI (Reuters) - It's too soon to bet that Nokia's on the road to recovery after its new Lumia smartphones were sold out in many stores across Europe and America, as retailers say supplies have been short ever since their launch.

The Lumia 920 and 820, which use Microsoft's latest Windows Phone 8 software, were launched last month with expectations of a "make or break" for Nokia, once the undisputed leader in mobile phones, now losing share in smartphones and lower-end handsets.

Positive online reviews and anecdotes of waiting lists for the 920, as well as Nokia's sales deal with China Mobile announced earlier this month, have helped Nokia shares rise over 40 percent in the past month.

But analysts say there's no proof that Lumia phones are making significant inroads on market leaders Samsung and Apple or that Chief Executive Stephen Elop's risky strategy of betting the company's future on Windows software was paying off.

"I think people are looking and saying, 'Hey, there aren't enough 920s in the market', but the reality is that the volume is so small. It's not going to move the needle," said Pacific Crest Securities analyst James Faucette.

Most analysts forecast Nokia will sell around 5 to 6 million Windows Phone devices in the fourth quarter, with over half of them older versions of Lumia, which have been heavily discounted.

That would be better than the 3 million Lumia smartphones sold in the third quarter, but it pales in comparison with Samsung, which champions Google's Android system and is expected to ship 60 million smartphones in October-December.

IMPROVEMENT FROM LOW BASE

Supplies of the new Lumia models appeared to be trickling back into U.S. stores this week after being unavailable at many stores since their November launch.

Best Buy's website showed 920s in stock, and Amazon listed them as the No. 2 best-selling AT&T phone on Tuesday, though they were still sold out in many European markets including Nokia's home base, Finland.

The company's flagship store in downtown Helsinki said there would be a wait of a few days for the Lumia 920. Finnish telecoms company DNA said "many hundreds" of customers were still on its waiting list and that the backlog was unlikely to be cleared before Christmas.

"The situation is that we still don't have the 920s," said DNA retail executive Sami Aavikko, saying consumer interest in Lumia had improved with the newest models while declining to give sales figures.

Some sources said one problem has been a shortage of Qualcomm chips. Qualcomm CEO Paul Jacobs said in November it would be "exiting the calendar year with supply and demand more evenly matched", and a spokeswoman declined to comment further.

Elop told Finland's public broadcaster YLE on Tuesday there was "very positive activity underway" with Lumia sales. Nokia has declined to comment on sales data or confirm any component shortages, and a spokesman said it was "working very hard to get devices into the hands of consumers as quickly as possible".

Given low supplies, however, analysts said it was hard to gauge the real level of demand for the new Lumia phones.

Some industry executives and analysts have said consumer recognition for Windows Phones has improved thanks to spending on billboards and other advertisements over the past month.

"Are they lining up like they do for the iPhone? No. Are sales covering our costs, for instance marketing? Yes," said Deutsche Telekom Germany's marketing chief, Michael Hagspihl.

Many telecoms carriers as well as network equipment executives are hoping the Lumia succeeds, to prevent Samsung and Apple from gaining too much power.

Nordea analyst Sami Sarkamies was one of the more optimistic analysts, saying investors should focus on the improvement, albeit from a low base.

"My take is that there we have a seen a pretty substantial development since last year," he said. "Previously there hadn't been that market pull."

TWO-YEAR TRANSITION

With Nokia burning through cash and having already sold off assets such as its head office, muddling along with modest sales is not an option. Some investors have said they want to see quarterly Lumia sales of around 10 million.

Many believe Nokia will need to change its strategy - and its leader - if there is no clear improvement in Lumia sales in the coming quarters.

The company has not set any targets, but Elop said in February 2011 that the company's transition would take two years, which leaves precious little time.

"I think they have more hard decisions ahead of them; not only what they do from a leadership perspective and strategic perspective, but also with whom they align themselves," said Faucette at Pacific Crest.

Speculation of a buyout by Microsoft have periodically lifted Nokia shares, but with so much uncertainty over future sales, few analysts recommend pricing in any potential buyout premium.

The market's average price target was around 2.30 euros, according to Thomson Reuters StarMine. The shares were up 8.1 percent at 3.21 euros late on Tuesday afternoon, breaking the 3 euro barrier for the first time since April.
